These Terms of Service ("Terms") govern use of the 1000bananas.com website and, together with a mutually executed partnership agreement, the services of 1000 Bananas, LLC ("1000 Bananas," "we," "us").

1. The Services

1000 Bananas provides technology-enabled strategic growth services for brands selling on Amazon, including advertising management, market and pricing intelligence, inventory-aware strategy, and analytics, delivered through our proprietary platform and hands-on partnership (the "Services"). Specific scope, fees, and service levels are defined in each partner's agreement. We work with a limited number of partner brands; nothing on the website constitutes an offer of service to any particular party.

2. Amazon authorization

The Services operate on data and controls accessed through Amazon's official Selling Partner API and Amazon Ads API under authorizations granted by each partner. Partners may revoke authorization at any time; revocation may limit or end our ability to provide the Services. We comply with Amazon's applicable policies, and nothing in the Services is intended to violate Amazon's terms applicable to sellers or developers.

3. Acceptable use of the website

You agree not to misuse the website — including attempting unauthorized access, scraping, interfering with its operation, or using it to transmit unlawful content.

4. Intellectual property

The website, the platform, and all underlying software, methodologies, models, analyses, and documentation are the exclusive property of 1000 Bananas or its licensors and are protected by intellectual-property law. No license to any of the foregoing is granted by these Terms or by use of the website. Partner data remains the property of the partner; we claim no ownership of it.

5. Confidentiality

Each party to a partnership agreement will protect the other's non-public information with at least reasonable care and use it only to perform under the agreement. Our strategies, tooling, and platform internals are confidential information of 1000 Bananas.

6. Disclaimers

The website and its content are provided "as is" for general information and do not constitute business, financial, or legal advice. E-commerce outcomes depend on factors outside any provider's control; except as expressly stated in a signed partnership agreement, we make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, and we do not guarantee specific results.

7. Limitation of liability

To the maximum extent permitted by law, 1000 Bananas will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues, arising from use of the website. Liability arising from the Services is governed exclusively by the applicable partnership agreement.

8. Termination

We may suspend or terminate website access for violation of these Terms. Partnership terms, including termination and its effects (such as data deletion under our Privacy Policy), are governed by the partnership agreement.

9. Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, and disputes arising from them are subject to the exclusive jurisdiction of the courts located in Sheridan County, Wyoming.

10. Changes

We may revise these Terms from time to time; continued use of the website after changes take effect constitutes acceptance. The effective date above reflects the latest revision.
